These Online Reocurring Subscription Model Terms and Conditions ("Agreement") govern the subscription services provided by Spiffy Window Cleaning ("Company") to the subscriber ("Subscriber") for the online monthly window cleaning subscription model. By subscribing to the monthly subscription model, the Subscriber agrees to be bound by the terms and conditions outlined in this Agreement.
The Company offers an online subscription service that provides professional window cleaning services for residential and commercial properties. The subscription includes the cleaning of interior and exterior windows, frame restoration, track cleaning, and the removal of light debris and adhesives.
The Company offers different subscription packages with varying levels of service, pricing, and frequency of window cleaning visits. The specific details of the subscription package chosen by the Subscriber will be outlined during the subscription process.
The Subscriber is eligible for a free clean as part of the subscription, subject to the following conditions:
The free clean offer is applicable to the Subscriber's first clean with the Company and is not applicable to subsequent cleans.
The Subscriber must save a valid credit card on file with the Company in order to redeem the free clean offer.
The Subscriber must agree to a weekly or biweekly subscription model to be eligible for the free clean offer.
If the Subscriber chooses a monthly subscription model, they will receive a 50% discount on their first clean, but the free clean offer does not apply.
If the Subscriber chooses a bimonthly subscription model, they will receive a 25% discount on their first clean, but the free clean offer does not apply.
If the Subscriber chooses a quarterly, semi-annual, or annual subscription model, they must pay the full price for each clean, and the free clean offer does not apply.
Subscribers opting for one-time cleans are not eligible for the free clean offer.
The Subscriber can enroll in the subscription model by visiting the Company's website or contacting the Company's customer service. The Subscriber will be required to provide accurate and complete information, including contact details and property address, to ensure the provision of services.
The Subscriber agrees to pay the subscription fee as specified in the subscription confirmation. The subscription fee may vary depending on the chosen package and any additional services requested by the Subscriber. All fees are subject to change with prior notice.
The Subscriber authorizes the Company to charge the provided payment method on a periodic basis for the subscription fee. Accepted payment methods include credit cards, or any other payment method accepted by the Company.
The subscription term will automatically renew on a periodic basis unless cancelled by either party in accordance with the cancellation policy outlined in Section 4 of this Agreement.
In the event of a failed payment, the Subscriber will be notified, and a grace period of [3 business days] will be granted to rectify the payment. Failure to make the payment within the grace period may result in the suspension or termination of the subscription.
The Company will schedule window cleaning visits according to the chosen subscription package. The specific date and time of each visit will be communicated to the subscriber in advance.
The Subscriber agrees to provide the Company with access to the property during the scheduled service visits. If access cannot be granted, the Subscriber must notify the Company at least [2 days] in advance to reschedule the visit.
The Subscriber may request modifications to the subscription service, such as changes in the cleaning frequency or additional services. The Company will make reasonable efforts to accommodate such requests but reserves the right to adjust pricing or decline the modification request.
The Subscriber acknowledges that windows may have pre-existing conditions, such as hard water stains or damaged frames, which may impact the final results of the window cleaning service. The Company will make reasonable efforts to improve the condition of the windows but does not guarantee complete removal of all pre-existing conditions.
The Subscriber may cancel the monthly subscription at any time by providing written notice to the Company. The cancellation will be effective at the end of the current billing cycle.
In the event of early termination of the subscription before the completion of the minimum subscription term, the Subscriber may be subject to early termination fees as specified in the subscription confirmation.
The Company reserves the right to terminate or suspend the subscription at any time due to non-compliance with this Agreement or for any other valid reason. In such cases, the Subscriber will be notified in writing.
No refunds will be provided for the unused portion of a subscription term, including any prepaid subscription fees.
The Company will provide window cleaning services in a professional and diligent manner, adhering to industry standards. The Subscriber acknowledges that windows may have pre-existing conditions, such as hard water stains or damaged frames, which may impact the final results.
The Company offers a satisfaction guarantee. If the Subscriber is not satisfied with the quality of the window cleaning service, they must notify the Company within 24 hours of the service completion. The Company will assess the situation and, at its discretion, may provide additional cleaning or take corrective measures to address any concerns.
The Company's liability for any damages arising from the provision of services under this Agreement is limited to the total amount paid by the Subscriber for the current billing cycle. The Company shall not be liable for any indirect, incidental, consequential, or punitive damages.
All intellectual property rights associated with the subscription services, including but not limited to trademarks, logos, copyrights, and proprietary information, belong exclusively to the Company.
The Subscriber shall not reproduce, distribute, modify, or create derivative works based on the subscription services or any related materials without prior written consent from the Company.
Both parties agree to maintain the confidentiality of any confidential information disclosed during the term of this Agreement. Confidential information includes trade secrets, business strategies, customer data, and pricing information.
This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in Vancouver, BC Canada.
Any disputes arising from or in connection with this Agreement shall be resolved through good-faith negotiations. If a resolution cannot be reached, either party may seek legal remedies in the appropriate jurisdiction.
If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
This Agreement constitutes the entire agreement between the parties regarding the subscription services and supersedes all prior agreements, understandings, or representations, whether oral or written.
By subscribing to the Spiffy Window Cleaning recurring subscription model, the Subscriber acknowledges that they have read, understood, and agreed to the terms and conditions outlined in this Agreement.
